Our Privacy Policy explains how TesterYou collects, uses, and discloses information about you. The terms “TesterYou” “we” “us” and “our” include TesterYou Bilisim Hizmetleri A.S. and our affiliates. We use the terms “member”, “tester”, “trainee” “client”, “you” and “your” to mean any person using our Platform, including any organization or person using the Platform on an organization’s behalf. This Privacy Policy applies to the processing of information about members and other individuals that we collect when you use our “Platform” which means any website, application, or services we offer, or when you communicate with us. For information about choices that we offer under this policy, please see “Your Choices” below. This Privacy Policy does not apply to the information that you may provide to third parties, such as training facilities, venues, and others with whom you may share information about yourself.

Your Privacy is important to us, and we are committed to protecting it through adherence to this Privacy policy.

By accessing or using the Service, you consent to the information collection, disclosure and use practices described in this Privacy Policy. Please note that certain features or services referenced in this Privacy Policy may not be offered on the Service at all times.

In Summary: We collect information about you when you:

-Create an account;

-Use the Platform;

-Make an order from the store

-Make a reservation/booking to a course/event

-Visit our website; and

-Communicate with us.

Specifically, we collect your name, surname, and your e-mail, and phone number (optional).

When you make a reservation/booking through us, we will collect the date, time and location of booking, and your billing address, and will pass this information to the relevant training venue together with your name, surname, e-mail and phone number.

We also collect information, such as usage statistics, by using cookies, server logs, and similar technologies.

If you elect to use certain features, we also collect information through other sources, such as social media services.

1.1. Information You Provide to Us

We collect information that you provide directly to us.

Personal Information: We collect information that you provide when you create an account, when you search for trainings or events, or when you make a booking, fill out a form, or communicate with us. The types of information that we may collect include your name, username, password, email address, postal address, phone number, payment method data, photos, choices of interests, and any other information that you choose to provide. We do not collect gender information, nor any information about racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union memberships, or sexual orientations.

Payment Information: If you use us to make or receive payments, we will also collect certain payment information, such as credit card, online payment services or other financial account information, and billing address, but we will not store any credit card information. During the payment process, we will make it visible to you which payment provider will be processing your payment information.

Identity Verification: We do not need your birthdate or any government ID or so during account creation. We may ask for such personal information, such as your date of birth or taxpayer identification number, to validate your identity or as may be required by law, such as to complete tax filings. We may request documents to verify this information, such as a copy of your government-issued identification or photo or a billing statement. You will be notified case by case for what specific cases such information will be used, and how and when the information will be stored, shared or shredded. Not providing such information for identity validation may result in your account to be terminated, or limited for certain uses of our platform.

General Audience Service: The Service is general audience and intended for users who are 16 years old and older. We do not knowingly collect Personal Information from anyone younger than age 16. If we become aware that a child younger than 16 has provided us with Personal Information knowingly or unknowingly, we will close the user account and delete such information from our files and systems. If you are the parent or legal guardian of a child younger than age 16 and believe that TesterYou has collected Personal Information from your child, please contact us at: [email protected]. Where the child is below the age of 16 years, such processing shall be lawful only if and to the extent that consent is given or authorised by the holder of parental responsibility over the child.

Non-Identifying Information/Usernames: We also may collect other information, such as zip codes, demographic data, information regarding your use of the Service, and general project-related data (“Non-Identifying Information”). We may aggregate information collected from TesterYou registered and non-registered users (“TesterYou Users”). We consider usernames to be Non-Identifying Information. Usernames are made public through the Service and are viewable by other TesterYou Users.

On occasion, the information that you give us when you interact with our social media pages may imply information about your beliefs, political views, health conditions; or your sexual identity. We do not collect nor process this information, and such information is bound the privacy policy of the 3rd party platforms such as, but not limited to Facebook, Twitter, Instagram, etc.

1.2 Information We Collect Automatically When You Use the Platform

When you use our Platform, we automatically collect information about you, including:

-Log Information: We collect log information about your use of the Platform, including the type of browser that you use; the time, duration and frequency of your access; Platform pages viewed; your IP address; and the last page you visited before visiting our Platform if applicable.

-Device Information: We collect information about the computer or mobile device that you use to access our Platform, including the hardware model, operating system and version, unique device identifiers, and mobile network information.

-Location Information: We may collect information about the location of your device each time you use our Platform based on your consent to the collection of this information. We do not store this information.

-Information Collected by Cookies and Other Tracking Technologies: We and our service providers collect information using various technologies, including cookies and pixel tags (which are also called clear GIFs, web beacons, or pixels). Cookies are small data files stored on your hard drive or in device memory that help us improve our Platform and your experience, and track usage of our Platform. Pixel tags are electronic images that may be used in our Platform or emails, and track usage of our Platform and effectiveness of communications.

1.3 Information we collect from the content you created

Community Forums, blog posts, feedback and reviews The Service may provide you the opportunity to participate and post content publicly in forums, on blogs, through interactive features of TesterYou and through other communication functionality (“Community Forums”). You may choose, through such features or otherwise, to submit or post questions, comments, or other content (collectively, “User Forum Content”). Please note that certain information, such as your name and Profile may be publicly displayed with your consent only to proceed so on the Service along with your User Forum Content. Please note that your use of Community Forums is subject to the General Terms of Service.

Note that anything you post to a Community Forum or to blog post is public — others will have access to your User Forum Content or blog post and may use it or share it with third parties. If you choose to voluntarily disclose Personal Information in your User Forum Content or use Community Forums to link to your Profile, that information will be considered public information and the protections of this Privacy Policy will not apply.

Testimonials We display personal testimonials of satisfied clients and users on our Service, in addition to other endorsements. With your consent we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at [email protected].

Feedback

We collect feedback from TesterYou Users and Clients about their experience with other TesterYou Users and Clients of our Service. Please note that any feedback you provide via the Service or feedback provided about you is publicly viewable via the Service. On very rare occasions, we may remove feedback pursuant to the relevant provisions of our Terms of Service.

1.4 Information We Collect From Other Sources

We may collect information about you from other sources, such as through certain features on the Platform you elect to use, but only where these third parties either have your consent or are otherwise legally permitted or required to disclose your information to us. Examples include:

– Social Media Services. If you register or log into your account through your Facebook account, we will have access to some of your third-party account information from that service, such as your name and other information collected from that account, and used for purposes such as improving your training session recommendations. We may also have access to third-party account information if you use the Platform feature to share a link.

-Member Content. We may receive information about you when you or another member uploads photos or posts other content to the Platform.

-Information From Other Third-Party Sources. In order to provide you with more tailored recommendations, we may obtain information about you from publicly and commercially available sources and other third parties as permitted by law. HOW WE RESPOND TO DO NOT TRACK SIGNALS

Please note that your browser setting may allow you to automatically transmit a “Do Not Track” signal to websites and online service you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, TesterYou does not alter its practices when it receives a “Do Not Track” signal from a visitor’s browser.   1. USE AND RETENTION OF INFORMATION

2.1 To operate our platform

We may use information about you for various purposes related to operating our Platform, including to:

1-Provide, maintain, and improve our Platform, including to process bookings, develop new products and services, and manage the performance of our Platform;

2-Display information about you, which will be visible on your profile;

3-Personalize the Platform, for example, to suggest content in which we think you may be interested. We however do not collect data around health, political opinions, religion, and sexual identity.

4-Allows you to share information about your use of the Platform through a third-party social media service, if you connect your account through that service (which you can turn off at any time) and to provide you with better recommendations;

5-Detect, investigate, and prevent fraudulent transactions, abuse, and other illegal activities; to protect the rights, property, or safety of TesterYou and others; to enforce compliance with our policies, and to comply with applicable law and government requests.

6-Perform accounting and administrative tasks, and enforce or manage legal claims.

2.2 To Communicate With You

We may use information about you for various purposes related to communicating with you, including to:

1-Respond to your comments, questions, and requests, and provide customer service;

2-Communicate with you, in accordance with your account settings and consent, about products, training venues, trainer, services offered by us and others, to provide news and information that we think will be of interest to you, to conduct online surveys, to contact you about training venues on our Platform and to otherwise communicate with you in accordance with Section 2.3;

3-Notify you about communications and contact requests of other members, in accordance with the communication preferences that you indicate in your account; and

4-Send you technical notices, updates, security alerts and support, and administrative messages.

2.3 To advertise

We may use information about you for various other purposes, including to:

1-Provide content, features, or sponsorships that match member profiles or interests;

2-Facilitate contests and other promotions;

3-Combine with information that we collect for the purposes described in this Privacy Policy; and

2.4 To support Legal Basis

Our legal basis for collecting and using the information described above will be in accordance with the General Data Protection Regulation no.679/2016 and will depend on the type of information and the specific context in which we collect it.

1-We process information about you in order to provide our services in accordance with our Terms of Service, for example to allow you to make bookings, buy store products, attend events, and or engage with the software testing and user experience communities.

2-We also process information about you where it is in our legitimate interests to do so and not overridden by your rights (for example, in some cases for direct marketing, fraud prevention, network and information systems security, responding to your communications, the operation of training venues, and improving our Platform).

3-In some cases, we may also have a legal obligation to collect information about you, or may otherwise need the information to protect your vital interests or those of another person.

4-We may also process information to comply with a legal requirement or to perform a contract.

  1. INFORMATION SHARING AND DISCLOSURE

In Summary: We do not share information about you in any way other than as described in this Privacy Policy.

We may disclose information about you:

-to members or social media services, subject to the choices you may make via the Platform;

-to training venues when you make a reservation/booking with us.

-to our third-party service providers who help us to operate or improve our Platform;

-to authorities to comply with legal obligations and to protect and defend our rights and property; and

-to an affiliate or successor entity as part of a corporate transaction.

We may also share de-identified or aggregated information.

We may share aggregated Non-Identifying Information and we may otherwise disclose Non-Identifying Information (including, without limitation, Hashed Information) to third parties. We do not share your Personal Information with third parties for those third parties’ marketing purposes unless we first provide you with the opportunity to opt-in to or opt-out of such sharing. We may also share the information we have collected about you, including Personal Information, as disclosed at the time you provide your information, with your consent, as otherwise described in this Privacy Policy, or in the following circumstances:

Information about Trainees Shared with trainers and venues: We share information regarding trainees making a booking, including information in their profiles with the respective Trainers/Venues.

Legal and Investigative Purposes: TesterYou will share information with government agencies as required by law, including without limitation, in connection with reporting earnings. We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), at the request of governmental authorities or other third parties conducting an investigation, to protect the property and rights of TesterYou or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, fraudulent, unethical or legally actionable activity. We may also use Device Identifiers to identify TesterYou Users, and may do so in cooperation with third parties at our discretion.

Internal and Business Transfers: TesterYou may share information, including Personal Information, with its partner companies, subsidiaries, and affiliates, primarily for business and operational purposes. We may sell, transfer or otherwise share some or all of our assets, which may include including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets (including, in each case, as part of the due-diligence process with any potential acquiring entity) or in the event of bankruptcy. You will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

  1. TRAINING VENUES, THIRD PARTY ANALYTICS PROVIDERS, AD SERVERS AND SIMILAR THIRD PARTIES

In Summary:

-With your permission, we may allow others to use technologies that collect information about you to provide analytic services, and to serve ads for TesterYou. You may be able to disable the collection or use of this information.

-This Privacy Policy is periodically updated, and does not apply to third parties, including the information you shared directly with training venues, where the respective training venue’s privacy policy will be in effect.

4.1. Sharing information with 3rd parties

With your permission, we may allow others to use cookies, web beacons, device identifiers, and other technologies to collect information about your use of the Platform and other websites and online services.

4.2 Data Retention

We may temporarily block your account if you have not logged in for three months or more. You may contact us if you wish to reactivate your account.

We retain certain information that we collect from you while you are a member of the Platform, and in certain cases where you have deleted your account, for the following reasons:

-So you can use our Platform;

-To ensure that we do not communicate with you if you have asked us not to;

-To provide you with payments or refund, if entitled;

-To provide accurate accounting information to training venues about the bookings you made

-To detect and prevent abuse of our Platform, illegal activities and breaches of our Terms of Service; and

-To comply with applicable legal, tax or accounting requirements.

When we have no ongoing legitimate business need to process your information, we will either delete or anonymize it.

4.3 Policy Scope

This Privacy Policy does not apply to information that you provide to third parties, such as training venues, or other members. Our Platform may direct you to a third-party service, such as social media services, or a portion of our Platform may be controlled by a third party (typically through the use of a frame or pop-up window separate from other content on our Platform). Disclosure of information to these third parties is subject to the relevant third party’s privacy policy. We are not responsible for the third-party privacy policy or content, even if we link to those services from our Platform or if we share information with these third parties.

4.4 Revisions To This Policy

We may modify this Privacy Policy from time to time. When we do, we will provide notice to you by publishing the most current version and revising the date at the top of this page. If we make any significant change to this policy, we will provide additional notice to you, such as by sending you an email or displaying a prominent notice on our Platform.

-You can review and change information about you or deactivate your account in your account settings, but we may retain certain information.

-With your consent, we will use information about your location to display you training activities in your area. You can deactivate this feature at any time through your device or browser settings.

-You have the right to opt out of receiving TesterYou’s promotional messages, but you may still receive other non-promotional communications.

You will also be able to choose what information others see about you and who may contact you by using the Privacy Settings section in your Account.

We may use and allow others to use cookies, web beacons, device identifiers, and other technologies to collect information about your use of the Platform and other websites and online services as outlined

5.3 Your Preferences: Promotional Communications

You can control messages that you receive from TesterYou, training venues, other members, and third parties by selecting the unsubscribe link in the message that you receive, or by adjusting the communication preferences in your account settings. If you opt out, we may still send you non-promotional messages, such as those about your account, your bookings and content you’ve created.

  1. CHANGING YOUR INFORMATION OR CLOSING YOUR ACCOUNT

In Summary:

-You may have the right to exercise your data protection rights, including to request that TesterYou deletes, amends, or provides you access to your information.

-You have the right to opt out of receiving TesterYou’s promotional messages, but you may still receive other communications such as updates about our legal terms and conditions and in case any major changes take place.

-You have the right to file a complaint to the National Supervisory Authority for Personal Data Processing about the use of your information.

We respond to all requests that we receive from individuals who wish to exercise their data protection rights in accordance with applicable data protection laws. You can contact us by sending an email to [email protected]

Rights that you may have, depending on the country in which you live, include to

-Access, correct, update, or request deletion of your information.

-Object to processing of your information, ask us to restrict processing of your information, or request the portability of your information.

-Opt out from receiving marketing communications that we send you at any time. You can set these preferences by selecting the “unsubscribe” or “opt-out” link in the marketing emails we send you. Additionally, you may update your email preferences by changing the settings in your account.

-Withdraw your consent at any time if we have collected and processed your information with your consent. Withdrawing your consent will not affect the lawfulness of any processing that we conducted prior to your withdrawal, nor will it affect processing of your information conducted in reliance on lawful processing grounds other than consent.

Note that TesterYou is a controller of your information. Other members, and/or training venue operators may also act as controllers of your information. You should contact them directly if you have any questions about how they use information that you have provided to them.

Our Service contains links to other websites. If you choose to click on a third party link, you will be directed to that third party’s website. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit Personal Information from you.
